Rebecca Engrav is a partner at Perkins Coie and Co-Chair of the firm’s Artificial Intelligence & Machine Learning industry group. She helps companies solve their highest-stakes privacy, data security, and AI challenges before government regulators and in litigation. Rebecca has successfully handled Federal Trade Commission (FTC) investigations on AI topics such as accuracy and bias/discrimination risks arising from AI, consent requirements for using data in AI training, B2B sales of user-created content for AI training, platform responsibility for the safety of AI technologies, and the accuracy of marketing statements about AI technologies, as well as dozens of other FTC investigations regarding data security, privacy, and advertising practices. She has successfully defended complex multistate attorneys general investigations and has helped companies respond to state AG inquiries regarding AI in multiple states.

 

Rebecca leverages her regulatory defense experience to provide sophisticated, nuanced product counseling advice regarding AI for companies at all points in the AI stack. She helps clients learn and understand which new AI-specific laws apply to them and how to knit together current and anticipated future requirements from the new AI-specific laws in multiple jurisdictions. She has drafted policies and internal governance frameworks to help clients synthesize compliance approaches for new AI-specific laws as well as existing laws in areas such as automated decision-making, privacy, sector-specific laws, Section 5/UDAP laws, and EU laws. In addition, she helps clients assess risks and identify proactive measures to guard against discrimination risks with AI.
